These Terms of Service ("Terms") govern your access to and use of the websites, applications, and online services provided by The Apothecary Os ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms and to our End User License Agreement. If you do not agree, do not use the Service.

2. Account Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, harmful, fraudulent, or abusive purpose;
  • Upload or transmit any malicious code, viruses, or harmful data;
  • Attempt to gain unauthorized access to any portion of the Service or related systems;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Scrape, harvest, or systematically extract content, ingredient data, or formulas;
  • Impersonate any person or misrepresent your affiliation with any entity;
  • Use the Service to harass, threaten, or harm others.

4. User Content & Saved Formulas

You retain ownership of the formulas, notes, and other content you create and save in your account ("User Content"). You grant us a limited, worldwide, royalty-free license to host, store, reproduce, and display your User Content solely for the purpose of operating and providing the Service to you.

You are solely responsible for your User Content and represent that you have all necessary rights to it.

5. Intellectual Property

The Service — including all software, text, graphics, logos, ingredient databases, calculator logic, educational content, and underlying technology — is owned by or licensed to The Apothecary Os and is protected by intellectual property laws. Except for the limited rights granted in these Terms and the EULA, no rights are transferred to you.

6. Cosmetic Safety Disclaimer

The Service is an educational and assistive tool for formulators. It does not provide medical, regulatory, or professional advice. Calculations, suggested usage rates, preservation guidance, and ingredient information are provided for reference only and may contain errors or omissions.

You are solely responsible for: verifying the safety, stability, and regulatory compliance of any product you formulate; performing appropriate patch testing and stability testing; and complying with all applicable laws and standards in your jurisdiction (including INCI, IFRA, FDA, EU Cosmetics Regulation, and local labeling requirements).

7. Account Termination

We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or the EULA, or for any conduct we deem harmful to other users, the Service, or third parties. You may terminate your account at any time by contacting us.

8. Disclaimers & Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. To the maximum extent permitted by law, The Apothecary Os shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of the Service or any products formulated using it.

9. Dispute Resolution & Governing Law

These Terms are governed by the laws of the jurisdiction in which The Apothecary Os operates, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the courts of that jurisdiction, and you consent to the exclusive personal jurisdiction and venue of such courts.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you through the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
