Terms of Service

By creating an account or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms and to our End User License Agreement. If you do not agree, do not use the Service.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree not to:

• Use the Service for any unlawful, harmful, fraudulent, or abusive purpose;
• Upload or transmit any malicious code, viruses, or harmful data;
• Attempt to gain unauthorized access to any portion of the Service or related systems;
• Interfere with or disrupt the integrity or performance of the Service;
• Scrape, harvest, or systematically extract content, ingredient data, or formulas;
• Impersonate any person or misrepresent your affiliation with any entity;
• Use the Service to harass, threaten, or harm others.

You retain ownership of the formulas, notes, and other content you create and save in your account ("User Content"). You grant us a limited, worldwide, royalty-free license to host, store, reproduce, and display your User Content solely for the purpose of operating and providing the Service to you.

You are solely responsible for your User Content and represent that you have all necessary rights to it.

The Service — including all software, text, graphics, logos, ingredient databases, calculator logic, educational content, and underlying technology — is owned by or licensed to The Apothecary Os and is protected by intellectual property laws. Except for the limited rights granted in these Terms and the EULA, no rights are transferred to you.

The Service is an educational and assistive tool for formulators. It does not provide medical, regulatory, or professional advice. Calculations, suggested usage rates, preservation guidance, and ingredient information are provided for reference only and may contain errors or omissions.

You are solely responsible for: verifying the safety, stability, and regulatory compliance of any product you formulate; performing appropriate patch testing and stability testing; and complying with all applicable laws and standards in your jurisdiction (including INCI, IFRA, FDA, EU Cosmetics Regulation, and local labeling requirements).

The free trial gives access to learning and test-batch tools. Tools for selling products, such as ingredient labels (INCI), per-unit costing, batch records, print and export, are available on paid plans only. Per-unit costing is included with Studio.

One free trial is allowed per person, email address, payment card or device. Creating multiple accounts to get extra trials, sharing a login, or trying to get around plan limits may lead to the account being closed.

We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or the EULA, or for any conduct we deem harmful to other users, the Service, or third parties. You may terminate your account at any time by contacting us.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. To the maximum extent permitted by law, The Apothecary Os shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of the Service or any products formulated using it.

These Terms are governed by the laws of the jurisdiction in which The Apothecary Os operates, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the courts of that jurisdiction, and you consent to the exclusive personal jurisdiction and venue of such courts.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you through the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

Some features let you use your own account with a third-party AI company (such as Anthropic, OpenAI, or Google). If you add an API key, you confirm it is yours to use, and you authorize us to store it encrypted and send it, with the content needed for each request, to that company on your behalf. That company bills you directly. Its terms, pricing, and privacy policy apply to your use of it, and we are not responsible for its charges, availability, or how it handles your data.

AI answers can be wrong or incomplete. They are educational guidance only, not a safety assessment, and are covered by the Cosmetic Safety Disclaimer above. Keep your key private, and remove or replace it at once if you think it has been exposed.

Nothing in the Service — including examples, AI-assisted answers, presets or calculators — is a statement that any ingredient or product is safe during pregnancy or breastfeeding, or for any medical condition. You are solely responsible for patch testing, safety assessment, and consulting a qualified healthcare professional. To the maximum extent permitted by law, The Apothecary Os is not liable for any reaction, injury, or loss arising from products you make, use, sell, or recommend.
